Introduction
In the 1970 Act of Occupational Safety and Health (OSHA law) sought to ensure that working conditions for all men and women enforced standards development, encourage and give a hand to the states efforts in assuring safe and healthy working environment/conditions, provide evidence-based research, create awareness of employee safety and health as well as preservation training and education to employees as they are working. Through the Act policy document the rules, rights, and regulation to be followed by employees and employers as stated and are applicable in the statutory presentation. This paper will discuss the employer and employee rights and responsibilities as stipulated by the OSHA law.
Under the OSHA law employers are mandated to provide a safe working place as their primary responsibility. Other rights and responsibilities attached to the employer in the OSHA laws state that it is their responsibility to provide a conducive working place free from serious hazardous situations as well as complying with rules, standards, and regulation stipulated in the Act. It's the employer's responsibility to ensure that his or her employees have and utilize the safety equipment and tools as well as to ensure proper maintenance of the safety gear equipment and tools. Again, the employer is mandated to endure proper labeling of potential hazard signs appropriately. On their part, it is the employer's right to obtain a detailed explanation of the cited violation of employee's safety and health standards. The employer has the right to negotiate and propose penalties, abatement epochs, violation correction as well as resolving disputes emanating from proposed agreements on correction and penalties.
Conclusion
Consequently, the employees are mandated to comply with ASHA laws with outlined rights and responsibilities to ensure their safety and healthy working environment. It is the employee's responsibility to read, understand and comply with the OSHA standards indicated on the posters provided at the job site. Employees are mandated to follow safety and health rules and regulations as well as reporting hazardous concerns at the workplace. They are responsible for reporting any occurrences of job-related illnesses and injuries as well as cooperating with OSHA compliances officials during hazard or on-job injury or illness investigation. Conclusively, the employees have protective and discrimination rights to ensure that their complaints on health and safety concerns are adhered to as well as safety protective gear is provided to stop deliberate health or life-threatening situation at the workplace.
