Introduction
An alien is an individual who is not a citizen of a particular country. An illegal alien is a foreigner who is inside a country where he or she has no legal right to be there. They are people who have entered another country using illegal immigration. Illegal aliens have constitutional rights in America. This paper will be a discussion of the powers that illegal aliens have in the USA.
Majority of the people claim that undocumented aliens do not have rights since they are lawbreakers and have entered the country illegally and have no loyalty to the USA. They claim that only the citizens of the USA protected by the constitution but this is not the matter .illegal aliens have constitutional rights that protect them(Cole, 367). Aliens usually enjoy many rights which are accorded to citizens. They have a chance of claiming protection under the constitution and bill of rights.
Illegal aliens have the right safe, healthy working conditions, fair wages, and equal pay for the same amount of work completed. Ike any other citizen of America, aliens have the right of being protected by their employers while at work in terms of their safety, payment, and proper health conditions. Upon arrival in the USA by illegal aliens and claiming their citizenship they have an opportunity like any other citizen of seeking for job opportunities upon acquiring one they are supposed to be treated the same way as American citizens.
The employer has the duty of ensuring that the illegal alien that he or she has employed is working under proper working conditions such as he or she should ensure that this alien has protective clothes and other protective wear. For instance, an illegal alien working in an electricity industry or welding industry he or he needs to be provided with sunglasses to prevent the damage of the eyes through the sparks of light that are usually emitted during the working hours. In any case, when the employer fails to protect the aliens working in his or her company or under his or her leadership, the alien can sue the employer.
The second right that illegal aliens are granted to is the right to freedom of expression and peaceful assembly as long as the aliens do not interfere with the security of the nation, the safety of the public, the order of the society or the moral and rights of other people. the aliens are given equal opportunity by the constitution of expressing themselves concerning the matters that are affecting them or those incidences happening in the country(Liao, 487). An alien has a right to complimenting good events in the country, complaining about a disgracing matter or reporting cases of harassment to the necessary authority. For instance, if an alien has been employed and he or she is being molested or mistreated, heorshe has the right of reporting the matter. Similarly, if the alien is receiving death threats from citizens of the USA, he or she has the right of publishing the incidence.
On the other hand, allies are given the freedom of assembly as long as they do not interfere with the law of the public. Aliens may assemble with their fellow aliens and have a discussion concerning their lives in America or share inspiration information that can be useful in bettering their lifestyles ad improve their standards of living while in a foreign country.
The third right that the American constitution grants illegal aliens is the right to social services, healthcare, education, and social entity(Petras, 80). Children of aliens are given the right of acquiring education to the level which they desire, Also, aliens can further their education while in the USA . all illegal aliens have the right of health care where if they are sick they can seek medical treatment in public health centers the same way as citizens without being discriminated or isolated.
On the other hand, aliens are given a right of social services such as attending kids festivals, bouncing castles, agricultural shows to mention a few. They don't need to be prohibited; they have freedom like the other legal citizens( Berk, Marc L., et al., 60). They should be served the same way as citizens . in conclusion, illegal aliens are individuals who have entered a country through illegal immigration. Illegal aliens in the USA are protected by the constitution. They have the rights that protect them constitutionally. Some of the rights that are granted to the aliens whenever they observe and respect the laws of the USA are, first, freedom of expression. Secondly, the right safe and healthy working conditions, fair wages, and equal pay for the same amount of work - lastly, the right to social services, education, healthcare, and social security.
