Introduction
While I was online searching for the various article which could relate to discrimination, I found so many cases but out of all of them one case stood out to me about a pregnant employee who worked at Chipotle who was decimated cause she was pregnant. This article is from August of 2016. According to the woman victim by the name Doris Hernandez Garcia, she told the managing director that she was pregnant and what the male manager did instead he kept restriction to her. Example of this restriction was that she was never allowed again to get water while she was thirsty at work. She was also not allowed even to get up and even take a shower break. Even going to her prenatal physician appointment was another restriction added on her. During the processing of the court case, Doris made a statement that the manager had not imposed these requirements to any non-employee. Eventual Doris was fired because she was leaving the job earlier than expected to go the appointment of the prenatal physician when she was following up for the baby. The manager of the organization was always distraught and didn't even give her permission do any of that.
After Doris was fired, she obtained a lawyer who she informed about her discrimination case, from the attorneys who took keen on the case and also the united states district court in the Washington DC. Doris was award 550,000 dollars for the discrimination case on her pregnancy against chipotle.
We can see that discrimination does take place in everyday life. Does this aspect make things right? We always have laws and regulations put in place so that people don't get scared of being discriminated in workplaces. It's a common question that to as if discrimination still take place today? Of course, discrimination is rampant and many companies have even become better about the discrimination of its co-workers. Just for example in a job interview, there are various companies make state before even the person leaves, "John, you don't seem qualified for the job because u look old for the position. And this can be considered as discrimination.
According to Doris, the discrimination case claims on Chipotle have substantial validity. Certainly, it was case define by a hostile environment (Whitten, 2016). This case is based on supporting evidence om Doris harassment by her manager claiming she had taken all the privileges from her that had constituent on others. I find it as, "immutable characteristics."
I think the manager was finding a reason to push her out of the job so that he could manage to do replacement once she was on her maternity leave and even place to access her FMLA. He was trying to confront her on things that could make her fed up and quit the job. This did not go well as the plan since Doris stuck up herself knowing very well the manager was wrong pressing on her.
Chipotle was forced to a fine of $550,000 to Doris after this case of discrimination and quickly formulate a plan to correct the mistake. After the incident, they would probably do research on discrimination matters and likely to higher an expert in that field to pass knowledge to the employee as well as manager of an organization about discrimination in depth (Armstrong, & Taylor, 2014). For chipotle case, they had to pay and face the repercussion since they had hired that specific manager for the work of that position. Companies should be responsible for properly educating the staff and employees on matters of law and ethics when they interact with each other as well as upholding federal Law.
